Terms of Service
These Terms govern your access to and use of KRYX Pay and the KRYX app, website, merchant dashboard, QR payment tools, payment request links, and related services. By using KRYX, you agree to these Terms.
1. About KRYX
KRYX is a payment request and payment experience platform that helps merchants create payment requests and helps customers review and confirm payments. KRYX is not a bank. Payment processing, card authorization, settlement, chargebacks, and related regulated payment services may be provided by third-party payment processors, banks, or card networks, including Paystack where applicable.
2. Eligibility
You must be legally capable of entering into a binding agreement and using payment services in your jurisdiction. If you use KRYX for a business, you confirm that you are authorized to bind that business to these Terms.
3. Accounts and Security
You are responsible for the accuracy of information you provide and for keeping your login credentials, devices, and account secure. You must notify us promptly if you suspect unauthorized access. We may refuse, suspend, or terminate accounts where required for security, fraud prevention, compliance, or legal reasons.
4. Customer Payment Flow
Customers must review the merchant name, amount, currency, and payment details before confirming a payment. By confirming a payment, you authorize the payment processor to process the transaction using the selected payment method or saved authorization where available.
5. Merchant Responsibilities
Merchants are responsible for the goods, services, prices, invoices, taxes, refunds, customer service, and legal compliance related to their business. Merchants must not use KRYX for illegal, misleading, fraudulent, high-risk, or prohibited activities. Merchants must provide accurate business and settlement information and cooperate with onboarding, compliance, dispute, and fraud reviews.
6. Payments, Fees, Refunds, and Disputes
Payments may be subject to processor, bank, card network, settlement, chargeback, and compliance rules. Fees, settlement timing, refunds, reversals, and chargebacks may depend on the payment provider and merchant configuration. KRYX does not promise instant settlement unless expressly enabled for a merchant in writing.
Refunds for goods or services are primarily between the customer and merchant, unless applicable law or payment network rules require otherwise.
7. Prohibited Use
You must not use KRYX to:
- Break any law, regulation, payment network rule, or third-party right.
- Commit fraud, money laundering, terrorist financing, account takeover, phishing, or identity abuse.
- Sell prohibited, counterfeit, harmful, illegal, or misleading goods or services.
- Interfere with KRYX systems, bypass security controls, reverse engineer non-public parts of the service, or overload our infrastructure.
- Submit false, misleading, or unauthorized payment requests.
8. Availability and Changes
We work to keep KRYX available, but we do not guarantee uninterrupted or error-free service. We may update, suspend, limit, or discontinue features to improve security, comply with law, maintain the service, or protect users.
9. Third-Party Services
KRYX may connect to third-party services such as payment processors, app stores, hosting providers, monitoring tools, banks, card networks, and POS systems. Their own terms and policies may apply. We are not responsible for third-party outages, decisions, processing delays, or requirements outside our control.
10. Intellectual Property
KRYX, including its brand, software, user interface, design, logos, and content, is owned by us or our licensors. You may not copy, modify, distribute, sell, or exploit KRYX except as allowed by these Terms or with our written permission. You retain ownership of your business content, but grant us the rights needed to operate and provide the service.
11. Privacy
Our handling of personal data is described in our Privacy Policy.
12. Termination
You may stop using KRYX at any time. We may suspend or terminate access if you breach these Terms, create risk, fail verification, violate payment provider rules, or if required for security, compliance, or legal reasons. Certain terms, including payment obligations, compliance, intellectual property, disclaimers, and limits of liability, survive termination.
13. Disclaimers
KRYX is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that every payment request will be paid, settled, authorized, or free from dispute.
14. Limitation of Liability
To the fullest extent permitted by law, KRYX will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or reputational harm arising from your use of the service.
15. Governing Law
These Terms are governed by the laws applicable to the legal entity operating KRYX, unless mandatory consumer or local law provides otherwise. For Nigerian company operations, Nigerian law may apply.
16. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users. Continued use of KRYX after changes become effective means you accept the updated Terms.
